If the prosecution's case is strong, Penny may take the stand. If he does, he can narrate the video that I saw where Neely was struggling forcefully against Penny and the other people trying to restrain him. When asked, "In the military, did they teach you how to kill people with your bare hands? Penny's Answer: Yes. Question: Could you have quickly broken Neely's neck while you were holding him? Penny's Answer: Yes. Question: Why didn't you? Penny's simple answer: I did not want to kill him. I just wanted to hold him until the police arrived."

It is going to be an interesting trial.

Excellent point. It might come to that. The length of him holding on would, in that sense, be a point in HIS favor. That's really interesting.

Good writeup. I was at 100 Centre St yesterday for several hours holding a sign that said "If the D.A. did his job, none of this would have happened." and a fair amount of people indicated that they agreed with my support of Daniel Penny. So maybe the politics are changing in NYC. The fact that Manhattan D.A. Alvin Bragg was so wrapped up in his convoluted Stormy Daniels case that he didn't have time (or desire) to bother keeping criminals off the streets may be influencing opinion even in NYC. I wrote a blog post on it as well on my substack.

Good on you for supporting Marine Penny. Bragg and the AG (former NYC council member) have lots in common. I don’t believe their actions are in the public interest only hungry for a taxpayer funded paycheck.

Key to me is that they were going to go to a grand jury -- as would normally be done -- but then the protests started and all of a sudden they went to an arrest. Shows it was all politically motivated. The toxicology wasn't even back at that point.

thanks paul . . . . and in re: burden of proof. : ppl. have the initial burden , yes of course, and it's a high one, ...but then the burden somewhat shjfts to deft. for a f f i r m a t i v e defenses,,,,,,, However : many cases hold it's not as high or as precise as the ppl's burden . . . . . so our marine here HAS to take the stand. if he was my client, i would push him forcefully to do so, saying this : " YOUNG MAN ! they want to essentially take ur life away from u . . . . . U need to do the same thing u did when u acted that day, more or less : put everything u got in front of that speeding freight train heading towards you, and hold ur ground/ defend ur life..... ..that means getting up there and speaking FROM THE HEART AND FROM THE GUT to your " peers" in all sincerity. " ( The ADA will not have an easy time cross-examining him. )

It's astonishing how there are no cameras . . . . ( still ! ) . . in New York courtrooms ......, ,although we require all our PDs to wear a camera at all times. So, when a LE encounter begins, we ' need ' a video camera, but when it concludes, .......we do NOT ? That does not make sense. How many states allow cameras in the courtroom ? I am guessing two-thirds of them. . . .time for NY to get with the

(televised) program. And my prediction here is an acquittal......IF Penny takes the stand and does a good job of conveying his state of mind in that half or quarter hour. The military expert ? I don't see much trouble there. Penny could truthfully say (or one of his own Self Defense experts could

say; ) " perps often play dead to get you to slack off ; then you slack off; then the perp stabs

you ") . .. The deft. continues, while LOOKING DIRECTLY AT THE JURY : " .and that was foremost in my mind, so i continued to hold him that way . . . . . and yes, jury members, I, Daniel Penny, am the only person on earth who can testify what was in my mind during that 15 minutes. "

Excellent points re: the cameras. And as another reader said, Penny could articulate that had he wanted to, he's been trained to kill -- so that he could have killed Neely AT ANY TIME had he wanted to. In that sense, hanging on almost becomes part of the defense. I find that a compelling argument.

Didn’t know that there was any character difference between Neely and Bragg. However Daniel Penny is a Marine. No Better Friend - No Worse Enemy. Marine Penny acted to save lives that day from a dangerous predator how by the way had previously been arrested 40 times and past history of violence on the subway. I support Marine Penny. If I was on that subway being attacked I know Marine Penny had my back. Nuf said.
